Terms of service

1. General Provisions

1.1. These standard terms of sale (hereinafter referred to as Terms) of ESFi OÜ, reg. no. 14307430, address Tepi talu, Harjumaa, 74636, Estonia (hereinafter referred to as the Seller) apply to all persons (hereinafter referred to as the Buyer and/or Customer) who purchase goods (hereinafter referred to as Product(s)) from the Seller's online store at https://elysiumskincare.eu (hereinafter referred to as the Online Store). The Buyer and Seller are hereinafter separately referred to as Party or jointly as Parties in these Terms and the sales contract (hereinafter referred to as the Contract) concluded between them.

1.2. These Terms form an integral part of the Contract concluded between the Seller and the Buyer.

1.3. In case of discrepancies between the Terms and the Contract, the provisions of the Contract and its annexes shall prevail.

1.3.1. The annexes to the Contract include amendments to the Contract, purchase orders, order confirmations issued by the Seller, invoices, and any additional written agreements between the Parties.

1.4. The Seller has the right to unilaterally amend or supplement the Terms by publishing the updated version here. If the Buyer places an order before the amendments come into effect, the terms applicable at the time of order placement shall apply.

1.5. In addition to the Contract and the Terms, purchases made in the Online Store are subject to the laws of the Republic of Estonia.


2. Prices & Payment

2.1. The prices applicable to the Buyer are those displayed in the Online Store at the time of purchase. The Seller has the right to offer discounts on the listed prices.

2.2. All prices are displayed in euros (€) and include VAT at the applicable rate (22%).

2.3. The Seller reserves the right to change the prices at any time. However, if the Buyer has placed an order before the price change, the price applicable at the time of order placement will be honored.


3. Placing an Order

3.1. The Buyer can place orders as a guest without logging in.

3.1.1. In the case of a guest checkout, the Customer must provide their name, address, phone number, and email address.

3.2. To purchase a Product, the Customer selects the desired item(s) from the Online Store and adds them to the shopping cart.

3.3. When placing an order, the Customer must select:

  • Product quantities
  • Delivery method & destination
  • Provide necessary delivery information
  • Agree to the Online Store's Terms before proceeding with payment

3.3.1. The Buyer must pay the full amount in advance, covering both the product price and delivery costs.

3.4. To complete the order, the required fields must be filled in, and the appropriate delivery method must be chosen. The total cost will then be displayed, which can be securely paid using the following payment methods:

3.4.1. Bank transfer to the Seller’s account (details provided on the invoice sent via email).
3.4.2. Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele.
3.4.3. Credit card payments: Visa/Mastercard.

3.5. When paying via bank link, the Customer must click "Return to Merchant" after completing the payment.

3.6. Bank link and Visa/Mastercard transactions are processed via Maksekeskus AS in a secure environment. The Seller does not have access to the Buyer's bank or credit card details.

3.7. The Seller is the data controller for personal data and forwards the necessary information to Maksekeskus AS for processing payments.

3.8. Before making payment, the Customer is responsible for reviewing the order details to ensure accuracy.

3.9. The Contract is considered valid once payment has been received in the Seller's account.

3.10. The Seller will confirm, reject, or modify the order within two (2) business days via email. If a product is out of stock, the Seller will notify the Customer with an estimated delivery time and updated pricing.

3.11. Once the order is paid for, the Seller will process and dispatch it according to the chosen delivery method.

3.12. If the Parties do not agree on product availability, pricing, quantity, or delivery timeframe, the order will be canceled and not processed.

3.13. If an ordered Product is unavailable, the Seller will refund the Customer within 7 calendar days.


4. Payment & Delivery

4.1. The Buyer must pay for the order in full before dispatch.

4.2. Orders are shipped to the Customer’s specified address using partner courier services.

4.3. Delivery Conditions:

  • Shipping costs are calculated based on the package's size and weight.
  • The Seller dispatches orders within 2 business days after confirming the purchase.
  • Delivery time depends on the courier’s schedule.

4.4. If the Seller fails to deliver within 10 business days, the Customer has the right to cancel the order by submitting a written notice.

4.5. Upon receiving the Product, the Buyer must open the package carefully. If the packaging is damaged due to negligence, the Seller may deduct compensation from the refund amount.

4.6. The delivered Product must match the order confirmation and comply with standard quality and labeling requirements.


5. Return Policy

5.1. The Buyer has a 14-day return right as per the Estonian Consumer Protection Act.

5.2. Returns are not accepted for:

  • Custom-made products
  • Perishable goods
  • Hygiene products with opened packaging

5.3. To return a Product, the Customer must submit a request via email at hello@elysiumskincare.eu.

5.4. The return shipping cost is covered by the Customer, except when the Product was defective.

5.5. Refunds will be processed within 14 calendar days after the Seller receives the returned Product.


6. Processing of Personal Data

6.1. The Seller processes the Customer's personal data in compliance with applicable laws for order fulfillment.

6.2. The Seller may use personal data for:

  • Order processing
  • Customer service
  • Business analytics
  • Improving services

6.3. Personal data is stored for 3 years from the date of purchase.

6.4. Customers have the right to request access, correction, or deletion of their personal data.

6.5. The Seller is the data controller, and personal data concerns can be addressed at hello@elysiumskincare.eu.


7. Final Provisions

7.1. Disputes shall be resolved through negotiations or by the Estonian courts.

7.2. If an event of force majeure prevents contract fulfillment, the Party must notify the other Party immediately.
